Identification Badges on Construction Sites: What Changes with Law 203/2024
The Italian National Labour Inspectorate has issued a new official note (No. 656 dated January 23, 2025) to clarify the changes introduced by Law 203/2024 regarding identification badges on construction sites. The most significant change is the repeal of certain paragraphs in Article 36-bis of Law Decree 223/2006, which previously governed the obligation to carry and display ID badges in the construction sector. However, this obligation has not been eliminated—it is now simply referred back to the provisions already contained in Legislative Decree 81/2008.
The INL confirms that employers are still required to provide identification badges (Art. 26, paragraph 8 of Legislative Decree 81/2008), and that workers and self-employed professionals are still required to display them (Art. 20, paragraph 3 and Art. 21, paragraph 1, letter c). Related sanctions also remain in force, ranging from those applicable to employers (Art. 55) to those applicable to workers and self-employed professionals (Arts. 59 and 60).
In the construction industry, where subcontracting is widespread, these clarifications are essential to avoid misinterpretations and potential penalties.
